What Is an Amicable Divorce?
An amicable divorce occurs when both partners agree on all key points: asset division, maintenance, custody and visitation rights, and division of household goods and the marital home. Only one lawyer is needed to file the divorce petition with the court.
The Process
First comes the mandatory separation year — at least 12 months of living apart. After the separation year, one partner hires a lawyer to file the petition. The other partner simply agrees. The court processes the application, conducts pension equalization if applicable, and schedules a hearing. Both partners appear in person, the judge confirms the marriage has broken down, and the divorce is pronounced.
Costs of an Amicable Divorce
Costs consist of court fees and one attorney's fee. For an average procedural value of €15,000 to €25,000, total costs range from €1,500 to €3,500 — less than half of a contested divorce.
